Please read these Terms of Service ("Terms") carefully before using wildsouthapparel.com (the "Site") operated by Wild South Apparel ("we," "us," or "our"). By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

We reserve the right to update these Terms at any time. Continued use of the Site following any changes constitutes your acceptance of the revised Terms. The most current version will always be posted on this page with the updated date.


1. Eligibility

By using our Site, you represent that you are at least 18 years of age, or are using the Site under the supervision of a parent or legal guardian. You agree that all information you provide to us is accurate, current, and complete. We reserve the right to refuse service to anyone for any reason at any time.


2. Products and Pricing

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. All prices are listed in U.S. dollars and are subject to change without notice.

We make every effort to display product colors and descriptions accurately. However, we cannot guarantee that your device's display accurately reflects the actual color of products. Minor variations in color, texture, or finish are not considered defects.

Pricing Errors: In the event a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel or refuse any order placed at the incorrect price, even after the order has been confirmed. We will notify you of any such cancellation and issue a full refund.


3. Orders and Payment

By placing an order, you represent that you are authorized to use the payment method provided. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to suspected fraud, inaccurate information, or product unavailability.

Payment is processed securely through Shopify Payments and other authorized payment processors. We do not store your full credit card information on our servers. By submitting an order, you authorize us to charge the total amount to your selected payment method.

You will receive an order confirmation email once your order is placed. This confirmation does not constitute acceptance of your order — acceptance occurs when your order ships.


4. Shipping and Fulfillment

We ship to addresses within the United States and select international destinations. Estimated shipping times are provided as a courtesy and are not guaranteed. Wild South Apparel is not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control.

Risk of loss and title for products pass to you upon delivery to the carrier. If your package is lost or damaged in transit, please contact us at Support@wildsouthapparel.com with your order number and we will work with you to resolve the issue.

Wild South Apparel is not responsible for orders shipped to incorrectly entered addresses. Please verify your shipping address before submitting your order.


5. Returns and Exchanges


Is your product the wrong size or style? Not a problem!

  • We have a 30-day policy for returns and exchanges
  • We offer free exchanges and returns. Item/items must be unwashed and unworn, with tags still on the clothing
  • Please allow 3–5 business days for refunds to original payments to process
  • Original shipping charge does not get refunded


To start a return or exchange, visit our Exchange/Return portal or email Support@wildsouthapparel.com with your order number in the subject line.

Defective Items

If your clothing item has a defect, please take a photo and send it to us immediately at Support@wildsouthapparel.com with a description of the issue. We will resolve the issue and send you a replacement at no cost.

Sale Items

  • All discounted and sale items are final sale and cannot be returned for a refund
  • If inventory permits, we will do our best to exchange sizes on sale items



6. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, product images, photographs, videos, audio clips, data compilations, and software — is the property of Wild South Apparel or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

Trademarks: "Wild South Apparel," "Wild South," "Ready When It Counts," and associated logos and brand marks are trademarks of Wild South Apparel. You may not use, copy, reproduce, or display any of our trademarks without prior written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our express prior written consent.

7. Prohibited Use

You agree not to use this Site for any unlawful purpose or in any way that could harm Wild South Apparel, its customers, or third parties. Prohibited activities include but are not limited to:

  • Using the Site to transmit spam, unsolicited messages, or harmful content
  • Attempting to gain unauthorized access to any portion of the Site or its related systems
  • Scraping, crawling, or harvesting data from the Site without express written permission
  • Using automated tools, bots, or scripts to interact with the Site
  • Purchasing products for the purpose of unauthorized resale or commercial distribution
  • Impersonating Wild South Apparel, its employees, or any other person or entity
  • Submitting false, misleading, or fraudulent orders or information
  • Using our brand assets, logos, or product images without written authorization


8. User-Generated Content

If you submit reviews, photos, comments, or other content to our Site or tag Wild South Apparel on social media, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content worldwide in any media for marketing, promotional, or commercial purposes.

You represent that you own or have the necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws. We reserve the right to remove any user-generated content at our discretion.


9. Ambassador and Affiliate Program

Participation in the Wild South Apparel Ambassador Program ("Wild South Field Crew") is subject to separate program terms provided at enrollment. By participating, ambassadors agree to represent the Wild South Apparel brand in a manner consistent with our brand values and guidelines.

Wild South Apparel reserves the right to terminate any ambassador or affiliate relationship at its sole discretion. Commission rates, discount codes, and program benefits are subject to change with reasonable notice. Ambassadors may not make false or misleading claims about Wild South Apparel products.

Affiliate commissions are earned only on qualifying purchases as defined in the program terms. Wild South Apparel is not responsible for commissions on fraudulent, returned, or cancelled orders.


10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Wild South Apparel does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.


11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WILD SOUTH APPAREL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Site or our products
  • Any unauthorized access to or use of our servers or your personal information
  • Any interruption or cessation of transmission to or from the Site
  • Any bugs, viruses, or other harmful code transmitted through the Site
  • Any errors or omissions in any content on the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.


12. Indemnification

You agree to defend, indemnify, and hold harmless Wild South Apparel and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including but not limited to any use of the Site’s content other than as expressly authorized.


13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

Informal Resolution: Before filing any formal legal claim, you agree to first contact us at Support@wildsouthapparel.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving notice.

Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Virginia Beach, Virginia. The arbitrator’s decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.


14. Third-Party Links and Services

Our Site may contain links to third-party websites or services that are not owned or controlled by Wild South Apparel. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.


15. Privacy

16. Termination

We reserve the right to terminate or suspend your access to the Site and any account you hold with us, at our sole discretion, without notice or liability, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.


17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on this Site, constitute the entire agreement between you and Wild South Apparel with respect to your use of the Site and supersede all prior agreements, understandings, and representations.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
